Terms of Service

These terms govern your use of BrandHum. By creating an account or using the service, you agree to them. If you are using BrandHum on behalf of a business, you agree on its behalf.

1. The service

BrandHum (“BrandHum”, “we”, “us”) is operated by Erikas Bulba, an individual based in Lithuania. Contact: hello@brandhum.io.

BrandHum lets you upload product photos and generate marketing copy and ad images using AI, in several languages. We may add, change, or remove features as the product evolves.

2. Accounts

You sign in with your email and a one-time code. You are responsible for keeping access to your email secure and for activity under your account. You must give accurate information and be at least 16 years old.

3. Credits and payment

• New accounts receive free credits on first sign-in. Generating copy or images consumes credits.
• You can buy additional credits in fixed packs. Purchased credits do not expire.
• First-purchase bonus: where we advertise extra credits on a first pack, the offer applies once per account, to the first pack you pay for, at the regular pack price. The bonus is fixed when you open the checkout, so the credit amount shown there is the amount granted. If you do not complete that checkout it is released and you can claim it again on a later purchase. A pack bought with the bonus counts as claimed even if it is later refunded, and we may change or withdraw the offer for future purchases at any time.
• Prices, including any applicable taxes, are shown before you confirm a purchase. Credits are a one-time purchase, not a subscription: nothing renews and we never charge you again unless you buy another pack.
• Payments are handled by our payment partner. When you pay by card, Apple Pay or Google Pay through our checkout, the order is processed by Polar (Polar Software Inc.), acting as the Merchant of Record and authorised reseller of BrandHum credits. Polar handles the payment, collects applicable taxes, and issues your invoice; your purchase is also subject to Polar’s Terms of Service.
• If a generation fails because of a fault on our side, we restore the credits it consumed.

Refund policy

• Credits unlock digital content you can use immediately. By buying a pack you agree that we start supplying the credits at once, and, where the law allows, that you waive the statutory 14-day right of withdrawal for digital content once credits from that pack have been used.
• Unused packs: if you have not spent any credits from a pack, you can request a full refund within 14 days of purchase.
• Faults on our side: if the service does not work as described (for example, generations repeatedly fail and the credits are not restored), contact us and we will restore the credits or refund the pack.
• Partly used packs are otherwise non-refundable, except where consumer law in your country gives you a right we cannot exclude.
• To request a refund, email hello@brandhum.io from your account address with the purchase date and amount, or reply to the Polar receipt sent to your email. Refunds go back to the original payment method, usually within 5-10 business days.

4. Your content

You keep all rights to the photos, text, and other material you upload (“your content”). You grant us a limited licence to host, process, and send your content to our AI providers solely to operate the service and produce results for you. You confirm you have the rights to the content you upload and that it does not infringe anyone else’s rights.

5. Generated output

As between you and us, the copy and images BrandHum produces for you are yours to use, including commercially. Note that AI output is not guaranteed to be unique, accurate, or free of third-party rights, and similar output may be generated for others. You are responsible for reviewing and editing output before you publish it, including checking facts, claims, measurements, and any trademarks or likenesses.

6. Acceptable use

You agree not to use BrandHum to:

• upload content you do not have the rights to, or that is illegal, infringing, or harmful;
• generate misleading claims, counterfeit listings, or content that deceives buyers;
• break the law, including consumer-protection and advertising rules in your market;
• generate sexual, pornographic, nude, or sexually suggestive content of any kind;
• generate content that depicts real people without their consent, or that harasses, threatens, or promotes violence, hate, or self-harm;
• abuse, overload, reverse-engineer, or attempt to circumvent limits or content safeguards of the service.

Every generation request (your text and the photos you upload) is screened by automated moderation before anything is generated; requests that breach these rules are blocked, no credits are charged for them, and repeated attempts disable generation on the account. We may suspend or close accounts that breach these terms.

7. AI disclaimer

BrandHum is an independent product built on top of third-party AI models (currently Google Gemini). We are not affiliated with or endorsed by Google or any other model provider; the models are integrations, not our own brand. Output can be inaccurate, biased, or unsuitable for your use. The service is provided “as is” and we do not warrant that output will be fit for any particular purpose. You use it at your own judgement.

8. Availability

We aim to keep BrandHum available but do not guarantee uninterrupted service. We may carry out maintenance, change providers, or suspend the service when needed.

9. Limitation of liability

To the extent permitted by law, BrandHum is not liable for indirect or consequential losses, lost profits, or lost data. Our total liability for any claim is limited to the amount you paid us for credits in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

10. Termination

You can stop using BrandHum at any time and ask us to delete your account. We may suspend or end your access if you breach these terms. Unused free credits carry no cash value.

11. Governing law

These terms are governed by the laws of the Republic of Lithuania, and disputes are subject to the courts of Lithuania, without affecting any mandatory consumer rights you have where you live.

12. Changes

We may update these terms. We will revise the date above and, for significant changes, notify you in the app or by email. Continuing to use BrandHum after a change means you accept the updated terms.
